SUNDAY IGBOHO'S N20 BILLION DEAL WITH DSS IS SET ASIDE BY THE APPEALS COURT

A court of appeal has overturned an N20 billion settlement given to Yoruba self-determination campaigner Sunday Adeyemo by an Oyo State High Court regarding the armed DSS agents' brutal entry into his Ibadan home.

Justice Muslim Hassan found that Justice Ladiran Akintola, who delivered the judgment on September 17, 2021, acted on the incorrect legal principles in awarding the cost to Igboho. The appeal was filed by the Attorney General of the Federation, State Security Service, and Director, State Security Service in Oyo State.

He said 

"Justice Akintola can’t assess damages claimed by Igboho using his own conceived parameters"

Justice Hassan nullified the N20 billion in an exemplary and aggravated damages awarded against the Department of State Security (DSS) for the attack, calling it outrageous. Justice Hassan also overturned the earlier ruling declaring the attack on the home of Yoruba nation agitator, Sunday Adeyemo, as illegal.

According to Hassan, the Oyo High Court assumed jurisdiction without considering the case's merits, and the judge shouldn't have given a verdict based solely on subjective criteria.
